Terms of Service

Last updated: 1 January 2025

Introduction

These Terms of Service (“Terms”) govern your access to and use of the 1Day platform, operated by 1Day Ltd (“1Day”, “we”, “us”, “our”). By creating an account or using our service, you agree to be bound by these Terms.

Please read them carefully. If you do not agree, do not use 1Day.

The service

1Day is a cloud-based property management system (PMS) for small and medium hotels and accommodation providers. The platform includes a booking calendar, channel manager, guest management tools, and related features as described on our website.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will give reasonable notice for material changes that affect your use of the platform.

Accounts & access

You must create an account to use 1Day. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete information during registration
  • You may not share your account with others or create accounts on behalf of others without authorisation
  • You must notify us immediately of any unauthorised access to your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Subscription & billing

1Day is offered on a month-to-month subscription basis. Pricing is based on the number of rooms at your property ($5 per room per month, minimum $10/month).

  • A 30-day free trial is available for new accounts, no credit card required
  • Subscriptions are billed monthly in advance
  • You can cancel at any time from your account settings
  • Cancellation takes effect at the end of the current billing period — no partial refunds are issued
  • If payment fails, we will retry and notify you by email before suspending access

Prices may change. We will give at least 30 days notice before any price increase takes effect for your account.

Acceptable use

You agree not to use 1Day to:

  • Violate any applicable laws or regulations
  • Infringe the intellectual property rights of others
  • Transmit spam, malware, or other harmful content
  • Attempt to gain unauthorised access to our systems or another user's account
  • Reverse-engineer, decompile, or extract the source code of our software
  • Resell or sublicense access to the platform without written permission

We may suspend your account immediately if we reasonably believe you are in breach of this section.

Your data

You own the data you input into 1Day — guest records, bookings, and property information remain yours. By using the platform, you grant us a limited licence to store and process this data solely to deliver the service.

You are responsible for ensuring that your collection and use of guest data complies with applicable privacy laws in your jurisdiction.

On account termination, you can export your data. We retain data for 90 days after account closure before permanent deletion. Refer to our Privacy Policy for full details.

Intellectual property

All software, content, trademarks, and other materials comprising the 1Day platform are owned by or licensed to 1Day Ltd. Nothing in these Terms grants you any rights in our intellectual property beyond the limited right to use the service as described here.

Disclaimers

1Day is provided “as is” and “as available”. While we work hard to keep the platform running reliably, we do not guarantee that it will be uninterrupted, error-free, or meet every specific requirement you have.

We are not responsible for any losses arising from channel manager connectivity issues with third-party OTAs, as those systems are outside our control.

Limitation of liability

To the maximum extent permitted by law, 1Day's total liability to you for any claim arising out of or related to these Terms or your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

Governing law

These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand, except where consumer protection laws in your jurisdiction provide otherwise.

Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email and by updating the “last updated” date below. Continued use of 1Day after the effective date of changes constitutes acceptance of the revised Terms.
